Gossip Girl actress Kelly Rutherford recently lost the case for the child custody against her ex- Daniel Giersch. Their two children, Hermes, and Helena will live with their father in Monaco while Kelly would only receive visiting privilege.

Kelly and Daniel married in 2006 and divorced in 2008 while they were still pregnant with their second child Helena. After being denied by the state of California and New York, the Monaco judge gave the order to them. Kelly is only permitted to ‘exercise her visiting and accommodation rights exclusively in France and Monaco.’

At least the case is over now, with over 3 years of appearing in various courts and legal dramas. According to Kelly, she had incurred around $1.5 million legal fees related to divorce alone. She even filed for bankruptcy in May 2013.

New York-based lawyer stated that the blame is partly contributed to Kelly as she had refused to return the kids

"Rutherford's visitation rights can only be used in France and Monaco, and the reason for that is because, this summer when she had visitation in America, she refused to return the kids, and courts really don't like self-help,"

Head of Family Group at Mischon de Reya, New York, Mr. Michael Statement agrees with her statement.

"The actions of Ms. Rutherford leading up to this ruling make the decision to award custody to Mr. Giersch the furthest thing from a surprise, Ms. Rutherford essentially had her head handed to her because she tried to take the law into her own hands."

Daily mail states that they will spend half of Christmas, spring and summer vacations with their father and half with their mother, with their father receiving the lion’s share of contact as the children will not only live with him but spend all of All Saints and the winter with him.

After her utmost failure to get the custody, she gave some useful advice to the people.

"Children need both parents," she told the Romanian edition of Elle magazine in a cover story. "You do not want to make them suffer. I hope that this story be an example to others. Now, I want them to be happy, to know that they are loved. No matter how long it takes this, I want them to know the truth."
